Se declaró la nulidad de todo lo actuado en la acción de tutela interpuesta por la ciudadana de la referencia contra la E.P.S.
HUMANA VIVIR, a partir del auto proferido por el Tribunal Superior de Cartagena Sala Civil Familia, lo anterior, porque la Corte advirtió que la aplicación del Decreto 1382 de 2000 es inconstitucional, como se ha reiterado en la jurisprudencia.
En consecuencia, se ordenó remitir el expediente al citada Sala competente para que realice el trámite que corresponda conforme a la ley.

- Segundo. REMITASE el expediente por Secretaria General al Tribunal Superior de Cartagena Sala Civil Familia, para que de manera inmediata se le imprima a esta accion de tutela el tramite que corresponda conforme a la Ley.
